We do not sell or give personal information. Our site does not use cookies or anything equal. Protecting our users is what makes us differ from many other providers. Our services exist to increase the privacy and security of people. We can go a long way in standing up for our clients but we cannot tolerate abuse like for example spamming and childporn. In such cases we will launch an investigation to find the responsible account and take further measures. It's in the world of today already hard enough for many people to do something simple without prying eyes or their own internet providers logging every move under recent laws. We welcome people who stand for freedom and understand that they have the right to be private. We do not store or view any piece of data which is generated by our clients. We reserve the right to refuse service to anyone for any reason in our sole discretion. If we determine with a new client that our solutions for some reason refuse to work within 3 days then we always offer a full refund to the client. We exist only in cyberspace; it is our believe that this way we can offer the best privacy services outthere. Although we are not tied to any specific jurisdiction we will not tolerate abusive behaviour and will protect our clients from suffering because of it! COMPLAINS & DISPUTES
All abuse complaints and disputes on issues not listed in our TOS will be dealt with according to the laws of Malaysia. The court of Malaysia shall have exclusive jurisdiction in the event of disputes resulting from or relating to any complaints, disputes or agreements between the Customer and the complainant. Should the complainant agreed to leave the dispute decision to the laws of Malaysia, the complainant shall accept that Hushhosting as the content hosting provider cannot be held liable for any consequential, incidental, exemplary, punitive or multiple damages. Until the decision of the dispute is made known, Hushhosting reserves the right to continue providing the services to the Customers.
SUSPENSION OF SERVICES
Suspension of services may be caused by abuse and violations of system or network security. These offences may result in suspension, cancellation or criminal and civil liability. Using Hushhosting network, services, or systems to store or send content which is illegal according to the laws of Malaysia is not permitted for any reason. Examples of system or network abuse or security violations include, without limitation, the following:
1. Hacking Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network.
2. Unauthorized Monitoring Unauthorized monitoring of data or traffic on any network or system without express authorization of the owner of the system or network.
3. Interference Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks.
4. Forging Forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.
5. Offensive Material Use of Hushhosting service to transmit any material (by e-mail, uploading, posting or otherwise) that threatens or encourages bodily harm or destruction of property.
6. Fraud Use of Hushhosting service to commit fraud, which including and not limiting to fake investment websites (convicted scams), speculation websites, fake banks and investment institution.
7. Virus, Trojan and Malware Distribution Use of Hushhosting service to distribute Virus or any other forms of data which can cause considerable harms to any network. Using or storing any type of software which is designed to or is likely to abuse or negatively impact Internet service, including, but not limited to, portscanners, hacking tools, ping flooding programs, security/root exploits, packet sniffers, and spam software.
8. Terrorism Activities Use of Hushhosting services to promote terrorist activities which including and not limiting to forums for terrorists, personal websites for terrorists, audio, photo and videos of terrorist activities.
9. System Resources Overload Overload of Hushhosting services until the system performance or other customers' business is affected which including and not limiting to CPU resources overload, bandwidth overload, memory resources overload, MySQL connections overload and massive email spamming by scripts.
10.UNSOLICITED E-MAIL & SPAM
HushHosting strictly upholds a zero-tolerance policy regarding unsolicited e-mail and spam sent over our network. Members are politely reminded to refrain from such practices as it will lead to immediate account termination without further reprieve. Members will be held responsible for any and all violations that may compromise server security. This includes hosting or permitting others to host scripts or software over our network that is otherwise recognized as spam.
11. Child Pornography Child pornography includes related material, such as simulated child pornography, non-nude child pornography, or sites linking to such material, whether it is determined to be legal or not. Offenses of this nature will be reported to the federal authorities and prosecuted to the fullest extent of the law. Customer is held fully responsible for any misuse of account regardless of whoever committed the act.
12. Russian Business Network (RBN) The Russian Business Network (commonly abbreviated as RBN) is a multi-faceted cybercrime organization, specializing in and in some cases monopolizing personal identity theft for resale. It is the originator of MPack (software) and an alleged operator of the Storm botnet. Due to the threat of RBN, SHINJIRU does not accept any customers from Eastern Europe countries such as Belarus, Bulgaria, Czech Republic, Hungary, Moldova, Poland, Romania, Russia, Slovakia and Ukraine. Should SHINJIRU discovers any customers from Eastern Europe countries or login from Eastern Europe IP, we reserve the right to suspend the account pending further investigation which may lead to account termination.
13. Storage Device Using a shared hosting account as a backup/storage device is strictly not permitted. Shared hosting account are meant for hosting Customer’s website content.
CONSENT & ACCOUNTABILITY
By purchasing and/or using HushHosting services, you acknowledge that you have read and understood the Terms and Conditions and that you agree to be bound by the Terms of Conditions and any reference thereof. We reserve the right to alter the Terms and Conditions without prior notice. We recommend daily data backups of all data and offer this service for an additional fee. However, we cannot be held accountable for any loss of data due to hardware or software failure. Any charges resulting from imprudent member actions will default to liable member accounts. We have sole ownership of all IP numbers and addresses, assigned to members. We may change or remove any and all IP numbers and addresses without prior notice. Our trademarks, trade names, and other names or marks are our exclusive property and may not be used without our prior consent. Members agree to pay all fees for additional services at standing rates. We reserve the right to change rates without prior notice.
PAYMENTS & REFUNDS
HusHosting automatically bills all accounts on a monthly, quarterly, semi-annual, or annual basis. Defaulting accounts will receive a courtesy email notification and a 24 hour grace period. Non-complying accounts will be deactivated, including all associated accounts. Accounts may be reinstated for a required $25 reactivation fee. We do not refund reactivation fees, incomplete membership fees, domain transfer or registration fees, scripting or software installation fees, or fees otherwise, after seven (7) days of initial account activation. Only fully prepaid monthly fees may receive a 75% refund within 5 business days.
ACCOUNT CANCELLATION
Please submit your request for cancellation by submitting a support ticket. Allow up to 3 days for your request to take effect. We require full account verification in order to process your request.
